TERMS OF SERVICE

1. Indemnification Policy

You agree to use all Dailyhost services and facilities at your own risk. Dailyhost specifically disclaims any warranties of merchantability and suitability for a specific purpose. Under no circumstances will Dailyhost be liable for any loss, data loss, or other business-related damages, including but not limited to special, incidental, consequential, or other damages. The customer agrees to defend, indemnify, save, and hold Dailyhost harmless from any and all claims, liabilities, losses, costs, and demands, including reasonable attorney fees, asserted against Dailyhost, its agents, customers, officers, and employees that may arise from any service provided or agreed to be provided, or from any product sold by the customer, its agents, employees, or assignees. The customer further agrees to defend and indemnify Dailyhost from any liability arising from injury to persons or property caused by products sold or otherwise distributed via Dailyhost’s servers.

Dailyhost reserves the right to intervene in any websites hosted on its servers to protect the interests of its customers. Any material provided by the customer that infringes or allegedly infringes on the proprietary rights of a third party, including copyright violations or defective products sold through Dailyhost’s servers, will be assessed solely by Dailyhost to determine if it violates this policy.

2. Billing

We currently offer billing on a monthly, quarterly, and annual basis depending on the chosen plan. If you’re not satisfied within the first 14 days (first invoice), we will gladly provide a full or partial refund, depending on the service (for certain special offers, the money-back guarantee may vary; Domain Name registration/transfer and Dedicated fees are non-refundable, as well as any payments made via paysafecard).

We accept Visa, MasterCard, American Express, Discover through PayPal’s gateway, as well as bank transfers and Bitcoin. For web hosting plans, we will set up your account without any upfront payment. Clients are encouraged to pay via PayPal or Bank Transfer as these are the most convenient methods at this time. There are no fixed-term contracts, but every subsequent period is automatically renewed unless we are notified otherwise. You must cancel your contract 14 days before the renewal date; otherwise, you are obligated to pay. If payment is still not made, we may proceed with legal action.

3. Late Payments

All accounts are billed according to the date they were first activated. If payment is not made within 2 days of the renewal due date, your account will be suspended. If payment is not received within 30 days (5 days for dedicated servers) after the due date, your account will be terminated. You will receive an email reminder 5 days before deactivation.

4. Acceptable Use Policy

All services provided by Dailyhost may only be used for lawful purposes. The transmission, storage, or presentation of any data, information, or material in violation of any applicable Greek federal, state, or local law is prohibited. This includes, but is not limited to, copyrighted material, content we deem threatening or obscene, or material protected by trade secrets or other regulations. The subscriber agrees to indemnify and hold Dailyhost and its employees harmless from any claims arising from the use of the service that harms the subscriber or any third party. Our Acceptable Use Policy is strictly enforced. Any offending content or users will be immediately suspended from our network upon discovery, and we will inform you of any actions taken. Pornography is strictly prohibited on all Dailyhost servers, including websites with explicit sexual content or hardcore imagery and/or advertising.

The subscriber acknowledges that the service provided may be interrupted for reasons beyond the company’s control, and that damages from such interruptions are difficult to ascertain. Therefore, the subscriber agrees that Dailyhost will not be held liable for damages caused by events beyond its direct and exclusive control. Furthermore, the company’s liability for its own negligence shall not exceed the amount paid by the subscriber for services during the period the damages occurred.

For web hosting, direct downloading is prohibited, and we bear no responsibility for data uploaded to our servers. Customers are responsible for maintaining their own backups, not Dailyhost. Dailyhost reserves the right to charge a fee for restoring backups if available. Our web hosting plans are designed to support most personal, small business, and organization websites. We do not limit storage or bandwidth usage as long as it complies with our fair usage policy. If your website’s bandwidth or storage usage threatens the stability, performance, or uptime of our servers, we will notify you by email. You may be required to upgrade to a dedicated server, or we may need to adjust the cost of hosting. If not, we may restrict your website’s resources. Violations of our fair usage policy are rare and typically involve websites used for file sharing or storage.

For free web hosting, stricter terms apply, and Dailyhost reserves the right to determine if any violations have occurred. Advertisements must be integrated into the website; otherwise, the service will be discontinued.

5. Bandwidth Usage

In some of our services, we offer unlimited bandwidth usage, subject to fair use. Should your usage exceed reasonable limits, we will contact you to upgrade. For streaming services, a maximum bandwidth of 500 GB per month applies, while certain web hosting packages are limited to 100 GB per month, at our discretion.

6. Limitation of Liability

Dailyhost will not be held liable for any claimed damages, including incidental or consequential damages, resulting from Dailyhost servers going offline or being unavailable for any reason. Moreover, Dailyhost will not be liable for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any website data on Dailyhost servers. All damages shall be limited to the immediate termination of service.

7. Disclaimer

Dailyhost is not responsible for system downtime, crashes, or data loss. We are not responsible for any predicted profits that clients would have earned if their website had been operational. Certain services provided by Dailyhost are resold from third parties. As such, Dailyhost does not own or control certain equipment, routing, software, or programming. Moreover, Dailyhost assumes no responsibility for the usage of its clients’ accounts. Failure to comply with any terms or conditions may result in account deactivation. We reserve the right to terminate any account without prior notice for any reason, at Dailyhost’s discretion. Additionally, Dailyhost reserves the right to modify any or all of the above policies, guidelines, and disclaimers without prior notice.
